End User License Agreement (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you (“Licensee” or “you”) and ebusd (“Licensor,” “we”, “our”, or “us”) regarding Your use of the ebusd software (“Software”). By installing or using the Software, you agree to be bound by this EULA. If you do not agree, you may not install or use the Software.

License Grant

Licensor grants you a non-exclusive, non-transferable, revocable license to use the Software on a single device for personal or commercial purposes (“License Token”), subject to this EULA and a purchase via Paddle.com.

License Token and Payment

The Software requires a License Token purchase via Paddle.com, our Merchant of Record. License Token terms, including pricing and renewals, are managed by Paddle.com under their terms. Paddle.com provides all customer service inquiries with regard to the purchase and also handles returns.

Intellectual Property

The Software and all related materials are owned by Licensor and protected by copyright and other intellectual property laws. You receive no ownership rights, only a license to use the Software as outlined herein.

Updates and Support

Licensor may provide updates or support at its discretion. Updates are subject to this EULA and only applicable when covered by the update window encoded in the License Token. Support is available via github issue tracker and via email at: support@ebusd.eu

Termination

This license terminates if you violate this EULA. Upon termination, you must cease using and delete the Software.

Disclaimer of Warranties

The Software is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted use.

Limitation of Liability

To the maximum extent permitted by law, Licensor shall not be held responsible for direct, indirect, incidental or consequential damages, or for the compensation of moral damages, costs, losses, decreases in the turnover, or any liabilities arising from your use of the Software. Total liability shall not exceed the amount paid for the License Token in the past 12 months.

Governing Law

This EULA is governed by the laws of Bavaria, Germany.

Changes to this EULA

Changes tho this EULA will be posted here with an updated effective date, and continued use constitutes acceptance.
