These Terms of Service (“Terms”) constitute the agreement between you (“You”) and ebusd (“we”, “our”, or “us”) regarding Your use of our website at ebusd.eu, ebusd.de, and ebusd.at including all subdomains (“Website”).
Use of the ebusd software (“Software”) is governed by our End User License Agreement (“EULA”).
Your use of the Website is subject to your acceptance and compliance with these Terms. By accessing or using the Website, you agree to these Terms. If you do not agree, you may not use the Website.
Use of the Website
You may use the Website to learn about ebusd and download the Software. You agree not to:
- Use the Website for illegal purposes or in violation of applicable laws,
- Attempt to hack, disrupt, or overload the Website or its servers,
- Scrape, reproduce, or distribute Website content without permission,
- Submit excessive or abusive support requests (e.g., repetitive, frivolous, or harassing inquiries),
- Engage in activities that impair Website functionality or harm other users,
- Use automated tools (e.g., bots, spiders) to access or extract data beyond normal use.
Software Downloads
The Website provides access to download the Software, either directly from your browser or via Over-the-Air-Update (“OTA”). Your use of the Software is subject to the EULA, including licensing terms, subscription requirements, and restrictions.
Intellectual Property
All content on the Website (e.g., text, images, logos) is owned by ebusd. You may not copy, modify, or distribute this content without our written consent, except for personal, non-commercial use as permitted.
Payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payments for Software processed by Paddle.com are subject to their terms. We do not store payment information on the Website.
Refunds
You may request full refund within 14 days of initial payment if the Software has not been activated or used yet via email at: support@ebusd.eu
Cookies
We do not use cookies on the Website.
During payment processing by Paddle.com, they will be using cookies and this is subject to their cookie policy to which you need to agree separately.
Termination
We may suspend or terminate your access to the Website if you violate these Terms, with or without notice. Upon termination, you must cease using the Website.
Disclaimer of Warranties
The Website is provided “as is” without warranties of any kind, express or implied, including accuracy or availability. We do not guarantee uninterrupted access.
Limitation of Liability
To the maximum extent permitted by law, ebusd is not liable for indirect, incidental, or consequential damages arising from your use of the Website. Our total liability shall not exceed the value of our Software purchased.
Governing Law
These Terms are governed by the laws of Bavaria, Germany, without regard to conflict of law principles.
Changes to these Terms
Changes to these Terms will be posted here with an updated effective date, and continued use constitutes acceptance.
